Limits how many top leadership jobs can be filled by political appointees. No more than 5 percent of the Department’s Senior Executive Service (SES) jobs can be held by noncareer appointees in any fiscal year. The “average number” used to calculate that 5 percent is found by adding the number of senior executives on the last day of each quarter of the prior fiscal year and taking 25 percent of that sum. Also, no more than the equivalent of 15 jobs may be taken out of the regular hiring rules because they are confidential or set policy. You cannot use someone’s political party or activity when hiring, assigning, or promoting employees in the Department. That rule does not apply to Presidential appointments (except for the Under Secretary for Health, the Under Secretary for Benefits, and the Inspector General), and it does not apply when filling SES noncareer positions or jobs that are exempt from regular hiring because they are confidential or policy-making.
