People who are a State member or alternate, or an officer or employee of the Appalachian Regional Commission must not take part in any specific Commission matter if they know that they, their spouse, minor child, partner, an organization where they hold a leadership or job role (except a State or local government), or anyone they serve with or are negotiating to work for has a financial interest in that matter. They can only take part if they first tell the Commission the full facts, get a written disclosure, and receive an advance written decision that the interest is not likely to affect their work. Violating this rule can bring a fine under title 18, up to two years in prison, or both. State members and alternates may get pay only from their own State. People detailed to the Commission under section 14306(a)(4) may get pay only from their original state, local, or intergovernmental employer or from the Commission. Breaking these pay rules can bring a fine under title 18, up to one year in prison, or both. The Federal Cochairman, the alternate to the Federal Cochairman, and federal officers or employees detailed under section 14306(a)(3) are not covered by these rules but remain subject to sections 202–209 of title 18. The Commission may void or cancel any contract, loan, or grant it finds was tainted by violations of these conflict or pay rules or by those criminal provisions.
