Breaking the rules in sections 6302 or 6303, or a rule made under section 6304, can lead to a fine under Title 18, up to 60 days in jail, or both. Those cases are handled in the Superior Court of the District of Columbia and are brought by information from the United States Attorney or an Assistant United States Attorney. If the illegal act damages property worth more than $100, the jail term can be up to five years. Those cases are prosecuted in the United States District Court for the District of Columbia by indictment, unless the defendant, after being told the charge and their rights, waives indictment in open court so the United States Attorney can proceed by information.
