When certified cost or pricing data are not needed for a contract, the contracting officer must ask for other data as needed to decide if the price is fair. Unless the contract is covered by the exception in section 3503(a)(1), the officer must at least get past sale prices for the same or similar items so the price can be judged. The Federal Acquisition Regulation must set limits on sales-data requests, require officers to ask only for information sellers normally keep and as little as possible, and forbid disclosing commercial information that is exempt under section 552(b) of title 5.
