Send any claim about a federal contract in writing to the contracting officer for a decision. The government’s claims about a contractor must also get a written decision from the contracting officer. Claims must be filed within 6 years after they arise, except the 6-year rule does not limit a government claim that is based on contractor fraud. For contractor claims over $100,000, the claim must include a signed certification saying the claim is honest, the supporting facts are true to the signer’s knowledge, the amount is correct, and the signer is authorized to make the claim. An authorized officer of the contractor may sign. If the certification is flawed, the contracting officer can tell the contractor in writing within 60 days and is not required to give a final decision until the defect is fixed; courts or boards can still require the certification be corrected before final judgment. The contracting officer must give a written decision and send it to the contractor. The decision must explain why and tell the contractor how to appeal. For claims $100,000 or less, a contractor can ask for a decision within 60 days and the officer must decide in that time. For certified claims over $100,000, the officer must decide or say when a decision will be made within 60 days. If the officer unreasonably delays, the delay counts as a denial and allows an appeal, though a court or board may pause the appeal to let the officer decide. Agency heads may not settle fraud claims. If a contractor’s fraud or misrepresentation makes part of a claim unsupported, the contractor must repay that part plus the government’s review costs, and liability is decided within 6 years of the fraud. The parties may use alternative dispute resolution under the rules in subchapter IV of chapter 5 of title 5; refusals must be explained in writing (the officer should cite section 572(b) of title 5 or give other reasons).
