Allows Social Security to pay a person's benefit to someone else — a representative payee — when that will better protect the person getting the benefit. Qualified individual: a person entitled to benefits under this part. Representative payee: a person or organization chosen to get and manage benefits for that person. Before naming a representative payee, Social Security must investigate the person or organization, including an ID check, verification of tax or Social Security numbers when available, checks for certain criminal convictions (including human trafficking, false imprisonment, kidnapping, rape/sexual assault, first‑degree homicide, robbery, fraud, theft of government funds, abuse or neglect, forgery, and identity theft), and whether the person previously misused benefit money. Social Security keeps lists of people who misused funds or were convicted of certain crimes, and it will not pay benefits to those people unless a case‑by‑case exemption is allowed. The agency must give written notice before payments are made, explain the right to appeal, and may delay direct payment up to 1 month (longer if the person is legally incompetent). Representative payees must report at least once a year on how they used the money, and Social Security can require extra reports or in‑person meetings if reports are missing or misuse is suspected. Payees who serve 15 or more people (or agencies that serve 50 or more) may get onsite reviews, and Social Security must report results within 120 days after each fiscal year. If a payee misuses money and Social Security failed to properly investigate or monitor, the agency must restore the misused amount to the beneficiary or a new payee, and payees who misuse funds are legally responsible to repay those amounts.
