Title 42 › CHAPTER 113 — STATE JUSTICE INSTITUTE › § 10702
Creates a private, nonprofit group called the State Justice Institute. Its job is to help improve how State courts work. It may incorporate in any State under section 10703(a)(6) and, as allowed by this chapter, use the powers given to nonprofits by the State where it is formed. The Institute must keep its main office in that State and have an agent there to accept legal papers. It can be treated under tax law as described in section 170(c)(2)(B) of title 26 and as a 501(c)(3) exempt organization under section 501(a) of title 26, and must follow the tax rules in title 26 if those treatments apply. The Institute must run a national help program so people have fair access to justice by funding State courts, national groups that support State courts, and other nonprofits that help meet its goals. It must work with the Federal courts on shared issues, promote the idea that separation of powers supports judicial independence, and support education for judges and court staff through national and State groups, including universities. It must not repeat work that other nonprofits already do well and must encourage State court agencies to take responsibility for federally funded improvement efforts. Before issuing rules or guidance, it must give notice, allow comment, and publish them in the Federal Register.
