Set up a state program to protect the rights of people with mental illness and give it clear powers and rules. The program must be able to investigate reported or likely abuse and neglect. It must use administrative or legal steps to protect people getting care and to act for a state resident who has been or was a person with mental illness. The program must be independent from agencies that provide treatment. It must be allowed into care facilities and, when authorized or when someone cannot give permission and there is a complaint or likely abuse, it must get records. If a guardian has been contacted but won’t act and the person’s safety is in immediate danger, the program can get records too. The program must set up an advisory council that includes lawyers, mental health workers, service providers, people who have received services, and family members, with at least 60% of members being service recipients or their family. The council must be chaired by a service recipient or a family member. The program must publish a yearly report by January 1, 1987 and every January 1 after that, hold an annual public comment chance, have a client grievance process, and not spend its federal allotment in ways that violate section 14404. The federal Secretary and the State agency that runs Medicaid must give the program copies of annual facility survey reports and plans to fix problems under Medicare and Medicaid. Those reports and plans must be provided within 30 days after they are finished. Each program must have a governing authority or board chosen by its rules, include people who know client needs (by October 1, 1990), and be responsible for planning and running the program and setting annual priorities together with the advisory council.
