Anyone (including insurance companies) that pays money to settle or satisfy a judgment in a medical malpractice claim must report the payment under section 11134. The report must name the physician or licensed health worker who benefits, the payment amount, any known hospital affiliation, a short description of the acts or injuries involved, and any other details the Secretary requires. If a party fails to report, it can be fined up to $10,000 for each unreported payment, with the fine imposed and collected the same way as civil money penalties under subsection (a) of section 1320a–7a. The Secretary must study and report to Congress, not later than two years after November 14, 1986, on whether small payments and all claims should be reported.
