Title 42 › CHAPTER 129 — NATIONAL AND COMMUNITY SERVICE › SUBCHAPTER I — NATIONAL AND COMMUNITY SERVICE STATE GRANT PROGRAM › § 12651b
The Board must meet at least three times each year. The Chair can call extra meetings, and six Board members can ask in writing for another meeting. More than half of the appointed members make a quorum. The Chair may run meetings, and the Vice Chair may run them if the Chair is absent. When members travel for Board business, they may get travel pay and per diem at the rates allowed for intermittent Government workers under subchapter I of chapter 57 of title 5. For certain federal laws (including chapter 11 of part I of title 18), a Board member is treated as a special Government employee. For tort claims (chapter 171 of title 28), a member is treated as a federal employee. Members generally are not personally liable for actions they take while doing Board work, except for criminal acts, willful or malicious misconduct, acts for private gain, or acts outside their Board duties. Chapter 10 of title 5 does not apply to the Board. Corporation employees must recuse themselves from decisions that pose conflicts of interest. The Board sets overall policy for the Corporation and must review and approve the strategic plan and annual updates, review the budget before it goes to OMB, approve proposals about grants/contracts/financial help/pay and staffing, approve rules and program plans, and approve the evaluation plan. The Board advises and reviews the CEO on personnel and program actions, tells the CEO when actions do not match the approved plans or goals, reviews the CEO’s performance each year and sends a report to the President, and receives reports required under 5 U.S.C. 414(b)–(d). The Board recommends research, advises the President and authorizing committees on national service developments, helps share information on programs, may make grants or contracts and enter agreements with federal agencies or nonprofits (including cost-sharing and requiring evaluation and performance standards), and must send recommended changes to the national service laws to the authorizing committees and the President by January 1, 2012. The Board must also review Corporation projects to improve coordination with other federal activities, and its ex officio members must jointly plan, run, and fund related efforts to address participants’ and communities’ needs.
