The Secretary will name a State or local government a participating jurisdiction when it follows rules the Secretary makes. Within 20 days after money for this program is available, the Secretary must divide the funds and tell each place its share (a special 20‑day rule applied in the first year after November 28, 1990). Groups of neighboring local governments can count as one unit if they have the power and staff to run the program and a State (or States) certifies they will work on housing problems in the State(s). A local government is eligible to become a participating jurisdiction if its formula share is $750,000 or more, or if it has a local housing authority, shows it can run the program, and the State or the locality adds enough money so the total reaches $750,000. Once money is added, that amount is treated as the locality’s future allocation. An eligible locality must tell the Secretary within 30 days if it wants to become participating, so the Secretary will reserve its funds. The locality then has 90 days to send a required housing strategy. If the locality or State fails these steps or the strategy is disapproved, the Secretary will reallocate the reserved funds by set rules: funds may be offered to other local applicants in the State for up to 12 months, returned to the State with local priority, or reallocated by formula. When a strategy is approved, the Secretary makes the place a participating jurisdiction and it stays one for future years unless the Secretary finds it cannot or will not run the program, or its allocations fall under specified dollar thresholds for the stated numbers of years. If annual appropriations are under $1,500,000,000, the dollar thresholds are lowered to $500,000, $410,000, and $335,000 as specified.
