§12841 Nonapplicability of Certain Requirements for Small Projects

Despite other laws, section 1701u and its rules don't apply to housing activities under this subchapter when the recipient is a State recipient or a participating jurisdiction under section 12746 with < $3,000,000 in last fiscal year, and the activity assists ≤50 units.

Title 42, §12841

Notwithstanding any other provision of law, the requirements of section 1701u of title 12, and any implementing regulations or guidance, shall not apply to an activity assisted under this subchapter that involves rehabilitation, construction, or other development of housing if—
(1)the recipient of assistance under this subchapter is—
(A)a State recipient pursuant to section 12746 of this title; or
(B)a participating jurisdiction that received a total allocation of less than $3,000,000 in the most recent fiscal year pursuant to section 12746 of this title; and
(2)the total number of dwelling units assisted as a part of such activity is not more than 50.
