People who lie, omit important facts, or recklessly ignore the truth when giving information used to decide monthly insurance benefits (subchapter II) or cash benefits (subchapter XVI) can lose those payments. If the false or misleading statement, or the withheld fact, affects the start or amount of benefits, the person can be stopped from getting those benefits. The penalty is no payment of subchapter II benefits the person would otherwise get and ineligibility for subchapter XVI cash benefits. The ban lasts 6 months for the first time, 12 months for the second, and 24 months for the third or later time. While banned, the person is still treated as if they were eligible and receiving benefits for deciding eligibility under subchapters XVIII and XIX and for figuring other people’s benefits. The rule also covers certain State supplementary payments paid by the Commissioner. The Commissioner must talk with the Social Security Inspector General before starting these actions.
