Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XI — GENERAL PROVISIONS, PEER REVIEW, AND ADMINISTRATIVE SIMPLIFICATION › Part A — General Provisions › § 1320a–8a
If a person lies, hides, or gives a misleading statement about an important fact when applying for or keeping monthly insurance benefits (subchapter II) or cash payments (subchapter XVI), the Commissioner of Social Security can stop those payments and make the person ineligible for the cash program. This can happen if the person knew or should have known the statement was false, acted with reckless disregard for the truth, or left out a fact they knew was important. The penalty lasts 6 months for the first finding, 12 months for the second, and 24 months for the third and later findings. A person who is penalized is still treated as if they were eligible and getting those benefits for deciding other program rules, such as eligibility under subchapters XVIII and XIX or benefits for another person. The term for these benefits also covers certain State supplementary payments made by the Commissioner. The Commissioner must talk with the Social Security Administration Inspector General before starting these actions.
