A State or any covered person can ask the Secretary for a waiver of the fuel-use rules. The Secretary must grant the waiver if the fleet will cut yearly petroleum use by the same amount full compliance with the fuel rules would produce, or, for certain State entities, by the amount their alternative-fuel vehicles would use if those vehicles ran on alternative fuel 100 percent of the time. The fleet must also meet all EPA vehicle emission standards. By December 31 of a model year, anyone who got a waiver must send the Secretary a report certifying the actual petroleum reduction for the prior model year and projecting the baseline reduction for the next model year. If they do not follow these rules, the Secretary must cancel the waiver and may impose a penalty under section 13262.
