Title 42 › CHAPTER 8 — LOW-INCOME HOUSING › SUBCHAPTER II–B — HOME RULE FLEXIBLE GRANT DEMONSTRATION › § 1437bbb–1
The Secretary must run a demonstration program that lets approved local areas combine covered housing aid and use performance-based contracts while they take part. Approved areas can use the funds to help low-income families move into work, to cut homelessness by providing permanent housing, to increase homeownership for low-income families, or for other housing purposes the area chooses. A jurisdiction may join for at least 1 and at most 5 fiscal years. During fiscal years 1999 through 2002, the Secretary can approve no more than 100 jurisdictions total; a jurisdiction approved in one year and continuing later still counts once. Generally the Secretary may only approve areas served by public housing agencies that are not high-performing and whose most recent score is in the lowest 40 percent. Of the approved jurisdictions, no more than 55 may be served by a PHA labeled “troubled” at approval, and no more than 45 may be served by a PHA not labeled “troubled.” If the City of Indianapolis applies and its application is approvable, the Secretary must approve it even if the high-performance rule would otherwise block it; Indianapolis still counts toward the numerical limits.
