Title 42 › CHAPTER 8 — LOW-INCOME HOUSING › SUBCHAPTER II–B — HOME RULE FLEXIBLE GRANT DEMONSTRATION › § 1437bbb–5
Local governments must apply to join the demonstration program. The application must come after a public hearing and include a housing plan the local government made that takes public comments into account. The plan must say any waiver requests, explain how it meets the program’s purposes, set proposed performance measures and the length of participation, and, if needed, include signed consent from other local officials or from each member of a consortium. The application must show the local government can manage the program (including past HUD experience), will avoid duplicate administrative costs, explain what public housing agencies will do, keep the program funds separate, describe how housing assets will be managed, list any state or local laws or contracts affected with a legal memo, and give steps for returning to covered assistance under subchapter I if the Secretary ends the demonstration. A plan can be in a memorandum of agreement with a public housing agency if filed with the application. The Secretary reviews each application and must tell the applicant within 90 days whether it is approvable. If approvable, affected public housing agencies get at least 30 days to comment. The Secretary will publish the decision and reasons. The Secretary may approve only approvable applications and will pick jurisdictions based on likely success in meeting goals and increasing housing choices. Approved jurisdictions must sign an agreement for a set period and meet agreed performance levels. Performance standards can cover goals such as helping families become self-sufficient, lowering per-family costs, expanding affordable housing and choices, better program management, more homeownership, reducing homelessness, and reducing concentration of assisted families. If a jurisdiction fails to meet the agreed levels, the Secretary will end its participation and require the return steps described in the application. The Secretary may set extra rules for troubled public housing agencies. Joining the program does not change a public housing agency’s legal status or its legal relationship with the local government. The Secretary may allow a streamlined public housing agency plan for participants.
