To get federal money, a State must run a program that protects and speaks up for people with developmental disabilities. That program must be able to use legal and administrative tools, give information and referrals, and investigate reports or signs of abuse or neglect. Each year it must set data-based goals and priorities, share those goals and its activities with the public (including people with disabilities and related groups), and let people comment. The program must have a client grievance process, be separate from any agency that provides services, not be run by the State Council on Developmental Disabilities, and be allowed to visit people where they get services. The program must be able to get relevant records in certain situations. If it asks in writing, it must get records within 3 business days. It must get records right away (within 24 hours) without another party’s permission if there is probable cause of serious immediate danger to a person’s health or safety, or if the person has died. The State must give the program copies of independent reviews of Intermediate Care Facilities within 30 days and information about home- and community-based waiver services. The program must hire enough trained staff and not be blocked by state hiring freezes or similar rules when federal funds are involved. The State must promise federal money will add to, not replace, state funding. An agency that runs the program can only be replaced for good cause after notice, chance to respond, public comment, and an appeal to the Secretary. A tribal consortium may also be funded and treated as a program. “Record” means reports from service sites, investigation reports about abuse/neglect/injury/death, and discharge planning records.
