Summary

Getting CIFIA credit help for a project does not change or cancel state or local rules. It does not free the person getting the help from getting any required state or local permits or approvals. It does not limit a state or local government’s power to approve or control how much profit private investors can make, and it does not override any state or local law or rule that applies to building or running the project.

Title 42, §16376

The provision of credit assistance under the CIFIA program with respect to a project shall not—

(1)relieve any recipient of the assistance of any project obligation to obtain any required State or local permit or approval with respect to the project;

(2)limit the right of any unit of State or local government to approve or regulate any rate of return on private equity invested in the project; or

(3)otherwise supersede any State or local law (including any regulation) applicable to the construction or operation of the project.
