Within 90 days after this part takes effect, the Commission must make a final rule that exempts holding companies, but only when they are dealing with one or more of three kinds of businesses: qualifying facilities under the Public Utility Regulatory Policies Act of 1978, exempt wholesale generators, and foreign utility companies. The Commission must also exempt a person or a transaction from federal access to books and records if someone applies or if the Commission itself finds that the person's records, or a whole class of transactions, are not relevant to the rates the Commission sets for public utilities or natural gas companies.
