Title 42 › Chapter 13A— CHILD NUTRITION › § 1774
The Secretary must hold back money meant for a State and pay it straight to schools or institutions in that State when the Secretary has been doing that without interruption since October 1, 1980. The money must be used the same way and follow the same rules as if the State had given it out. If the Secretary is running a program in a State, the State can ask to take over. If a State education agency is not allowed by law to give the money to any nonpublic (private) schools, the Secretary must pay those schools directly for the same purposes and under the same rules that apply to public schools.
