Section 1178 of the Social Security Act applies to rules under this subchapter the same way it applies to part C and to the standards in sections 1172–1174. The Secretary’s HIPAA privacy and security rules under sections 262(a) and 264 of the Health Insurance Portability and Accountability Act of 1996 stay in effect if they are consistent with this subchapter, and the Secretary must update federal regulations as needed to make them consistent. Nothing in this subchapter removes any legal privilege a person has over their protected health information.
