The Director of the Office of Personnel Management must sign contracts with health insurers so that each State Exchange offers at least 2 multi‑State qualified health plans. These plans can be for individuals or for small‑employer groups. Contracts can skip the normal federal competitive‑bidding rules. Each contract must last at least 1 year and can renew automatically unless ended. At least one contract must be with a non‑profit. The Director will set rules like medical loss ratios, profit limits, premiums, and other terms to protect enrollees, and can block any plan that does not meet those rules. The Director must also make sure at least one plan leaves out the specific services listed in section 18023(b)(1)(B)(i). Contract approval can only be taken away after notice and a hearing. A plan must offer the same basic benefits in every State, including the essential health benefits named in section 18022. Plans must follow the rules for qualified health plans, include bronze/silver/gold and catastrophic levels, and generally use federal rating rules for premiums. Issuers must be licensed in each State and follow State laws that do not conflict with this law. States may require more benefits than the federal minimum. People in these plans get the same premium tax credits and cost‑sharing help as other qualified plan enrollees (see section 36B of title 26 and section 18071). Start‑up rules let a new issuer roll out nationally over several years: at least 60% of States in year one, 70% in year two, 85% in year three, and all States after that. The program must be run separately from the Federal Employees Health Benefit Program, may have its own staff and advisory board (with many members who are enrollees), and funding may be provided as needed.
