Defines key words used when federal agencies give research money. "Covered individual" is a person who makes a real, important contribution to a funded research project and who the agency calls a covered individual. "Foreign country of concern" is the People's Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, the Islamic Republic of Iran, or any other country the Secretary of State later names. "Foreign entity of concern" is an organization that is on the Secretary of State’s terrorist list, on the Treasury Department’s SDN list, owned or controlled by a covered nation (see 10 U.S.C. 4872), alleged by the Attorney General to have committed crimes listed in chapter 37 of title 18; section 951 or 1030 of title 18; chapter 90 of title 18; the Arms Export Control Act (22 U.S.C. 2751 et seq.); sections 2274, 2275, 2276, 2277, or 2284 of this title; the Export Control Reform Act of 2018 (50 U.S.C. 4801 et seq.); or the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), or found by the Secretary of Commerce (after consulting Defense and Intelligence) to be doing unauthorized actions harmful to U.S. national security or foreign policy. "Malign foreign talent recruitment program" covers any program or job that offers money, funding, titles, travel, or other valuable rewards from a foreign country or its groups to get a researcher to transfer U.S. intellectual property or nonpublic data without permission, recruit others, take foreign positions that violate award rules, be unable to quit, limit or duplicate U.S. award work, require foreign funding through the sponsor, hide the U.S. institution or sponsor, hide participation from the U.S. agency or employer, or create conflicts of interest or commitment; it also includes programs sponsored by a foreign country of concern, certain listed foreign academic institutions, or listed foreign talent programs.
