Title 42 › CHAPTER 165 — INCREASING HOUSING SUPPLY › SUBCHAPTER I — BUILDING MORE IN AMERICA › § 19502
Creates a pilot program that gives grants to states, local governments, tribes, or qualified groups so they can fund “whole-home repairs” for low-income homeowners and small landlords. Whole-home repairs means changes for accessibility (like ramps or wider doorways), fixes for safety and habitability, and energy or water efficiency work. Homeowners are eligible if their household income is at or below 80% of area median income or if they already qualify for programs like Medicaid, CHIP, SSI, SNAP, or TANF. Small landlords qualify if they own fewer than 10 eligible rental properties, no more than 25 total units, and agree to the program rules. Grants to homeowners and loans to landlords must use HUD-approved maximum amounts based on local costs. Loans can be forgivable after up to 3 years if the landlord follows the rules. Up to 5% of funds may be used for related workforce training and up to 10% for admin. HUD will fund between 2 and 10 implementing organizations each year, no more than one per State, and the pilot ends on October 1, 2031. Implementing organizations must coordinate with other federal, state, tribal, and local home-repair programs to avoid duplicate benefits and must follow federal accessibility and fair housing rules. Landlords getting loans must keep units affordable, meet local codes, have no serious renter-protection violations in the last 10 years, offer current tenants a lease extension or keep a unit affordable for 3 years, and limit rent increases to 5% of base rent or the rate of inflation (whichever is lower) for at least 3 years. Grantees must report yearly to HUD on units served, costs, demographics, and anti-fraud plans. HUD’s inspector general will review the program at least twice during the pilot, and grants are subject to HUD’s environmental review rules.
