If a person knows a planned wrong listed in section 1985 is about to happen and they could stop it but refuse or fail to do so, they must pay for the harm that their reasonable effort would have prevented. The injured person or their legal representative can sue, and several neglectful people can be sued together. If the victim dies, the victim’s legal representatives can sue and recover up to $5,000 for the widow or, if none, the next of kin. The lawsuit must start within one year after the claim arises.
