Title 42 › Chapter 22— INDIAN HOSPITALS AND HEALTH FACILITIES › Subchapter I— MAINTENANCE AND OPERATION › § 2002
The Secretary of Health and Human Services can make contracts to transfer Indian hospitals and health centers (with initial equipment and supplies) to a State, Territory, local government, or private nonprofit when doing so will better meet Indian health needs. Transferred facilities must be kept available for Indians and give Indian patients priority over non-Indian patients. A hospital built or kept for a specific tribe or group of tribes cannot be given to a non-Indian group unless the tribe’s tribal government, or a majority of the tribes’ governments, agree. If a transferred facility is later found not to serve Indian needs, the Secretary will tell its managers what to fix and set a deadline. If fixes are not made, the Secretary will take back control right away.
