The Secretary can hire fiscal agents to handle payments for health services. These agents decide how much to pay people who provide care for eligible American Indians on behalf of the Indian Health Service and for people who provide care under sections 247d or 249 for the Public Health Service. They can receive, pay out, and track funds, audit records to make sure payments are correct, and do other necessary tasks. These contracts can be made without following competition rules like section 6101 of title 41, but only if the Secretary finds the agent will work efficiently and meet rules about finances, legal authority, and other relevant matters. Contracts may include advance payments. Subsections (d) and (e) of section 1395u apply. "Fiscal agent" means the carrier in section 1395u(f)(1) and, for Indian Health Service contracts, can include an Indian tribe or tribal organization under the Indian Self-Determination Act (Public Law 93–638, 25 U.S.C. 5321 et seq.).
