Places where Corps members work must not refuse care or treat someone worse because they cannot pay. They also must not refuse or treat someone worse just because the bill would be paid by Medicare (Title XVIII of the Social Security Act, 42 U.S.C. 1395 et seq.), Medicaid (Title XIX, 42 U.S.C. 1396 et seq.), or the State Children’s Health Insurance Program (Title XXI, 42 U.S.C. 1397aa et seq.). Those places must make a fee list that follows local rates and covers their costs. They must also make a schedule of discounts or waivers and change discounts based on a patient’s ability to pay. They must try reasonably to collect fees and give the proper discounts. For patients on the listed programs, the place must accept assignment under section 1842(b)(3)(B)(ii) of the Social Security Act (42 U.S.C. 1395u(b)(3)(B)(ii)) for Medicare and must enter into agreements with the State agencies that run Medicaid and the State Children’s Health Insurance Program. They must also try to collect payments from any third party (including government agencies) that is responsible for the bill.
