Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER III — NATIONAL RESEARCH INSTITUTES › Part H — General Provisions › § 289a–1
The Secretary may not approve or pay for research unless the project first gets the proper reviews. If an Institutional Review Board must review the work, the Board must review it under the rules and a majority must recommend approval. For clinical research done by the NIH, the NIH review rules must recommend the work before it can go ahead. For NIH research proposals, the plan must pass technical and scientific peer review with a majority recommendation, and a majority of the appropriate advisory council must also recommend approval. If a project is recommended for approval, the Secretary cannot refuse to fund it for "ethical considerations" unless an ethics advisory board is set up to study the matter. The Secretary must publish a notice and wait 30 days for suggestions before naming members. The board must have 14–20 outside experts (including at least one attorney, one ethicist, one practicing physician, one theologian, and between one-third and one-half scientists). The board holds public hearings, can see all relevant HHS information, and must send a report and recommendation to the Secretary and to the House Committee on Energy and Commerce and the Senate Committee on Labor and Human Resources within 180 days. The Secretary may withhold funds only if a majority of the board recommends withholding, or if the board recommends not withholding but the Secretary finds that recommendation arbitrary and capricious. The Secretary may still refuse funds for poor qualifications of the research team or because of funding priorities. An ethics board ends 30 days after it files its report. "Ethical considerations" here means whether the research is so wrong that it should not be done or supported.
