The Secretary can give an eligible lender a certificate that insures a loan when the lender applies with the forms, information, and proof the Secretary requires and the loan meets the rules. The insurance usually starts on the date the certificate is issued. The Secretary may also promise coverage in advance so the certificate can be effective from the date a covered loan or a payment from a line of credit is made to a student (see section 292d(a)(1)). The insurance stops if the lender is 60 days late in paying the required premiums (see section 292g). An application must include the lender’s agreement to pay those premiums and to send the reports and statements the Secretary requires. Instead of a separate certificate for each loan, the Secretary may issue one comprehensive certificate that covers all insurable loans the lender makes from the certificate date until a stated cutoff date, up to a total amount in the certificate. The Secretary can set conditions, require reporting, and confirm coverage of specific loans by endorsement; those confirmations cannot be challenged except for fraud, misrepresentation of fact, or patent error. Insurance rights can be assigned only to another eligible lender (including a public entity that buys student loans) or to the Student Loan Marketing Association. Combining or refinancing federally insured loans does not cancel the insurance; the Secretary may issue a new certificate or amend a comprehensive one. Lender and borrower may agree to consolidate loans (or, if the borrower had only one insured loan, refinance it one time), and the lender should fully explain the pros and cons. Loans consolidated under section 1078–3 of title 20 are not eligible for special allowance payments under section 1087–1 of title 20.
