The Commissioner can give one-year or multi-year money to public and nonprofit groups that serve Native people. This includes Tribal governments on Federal or State lands, Alaska Native villages and corporations, groups for Native Hawaiians, urban or rural Indian and Alaska Native organizations, and Native American Pacific Islander groups (including American Samoan Natives). The Commissioner will check with other Federal agencies to avoid duplicate work and will decide without regard to whether the people helped are members of a federally recognized tribe. Up to half of the funds must be given first to projects that build Tribal codes or court systems for economic development, create community development financial institutions, or make Tribal master plans for community and economic development and infrastructure. Native community development financial institutions may also get help. Most projects can get up to 80% of their approved costs paid by these grants. Non‑Federal partners must cover the remaining up to 20% with cash or fair-value goods and services, unless the Commissioner allows more than 80% under set rules. Projects must add new activity, not replace work already done without Federal help, though the Commissioner can waive that rule for hardship. Agencies cannot be turned down just because they serve Indians outside reservations. The Commissioner must also give grants to Tribes to pay 80% of the costs to build Tribal environmental law and enforcement capacity. Those grants can pay for training, writing Tribal environmental laws, and enforcing or monitoring those laws. The unpaid 20% may be cash or property but cannot come from any program, contract, or grant under this subchapter. Grants are made from applications the Commissioner requires.
