The Secretary sets rules for grants and contracts under this law. The Secretary also decides how much each grant will pay. For projects that start in a fiscal year after June 30, 1975, grants must pay at least 90% of the project’s costs as the Secretary defines them. One exception: if the same project got less than 90% for the fiscal year ending June 30, 1975, future grants can be made at that same lower percentage, but not lower. Grants can be paid in installments and can have conditions to make sure the money is used for its purpose. Grants or contracts for family planning (under sections 300 or 300a) must promise to give priority to people from low-income families and not charge them for services unless a third party (including a government agency) is going to pay. Grants or contracts under section 300 or 300a–3 must promise that any informational or educational materials are suitable for the audience, considering their education, culture, and community standards. For grants under section 300, those materials must be reviewed and approved first by an advisory committee set up by the grantee that represents the community and follows the Secretary’s rules.
