Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXIV — HIV HEALTH CARE SERVICES PROGRAM › Part B — Care Grant Program › subpart i — general grant provisions › § 300ff–22
States must use federal HIV grant money for three things: core medical care, support services, and administrative costs. For each grant year, after the required set-asides, at least 75% of the remaining funds must pay for core medical services for eligible people with HIV, including care for related conditions. The Secretary can waive that 75% rule if the State has no waiting lists for the AIDS Drug Assistance Program and if core medical services are available to all eligible people. When a grant is made, the State will be told whether that waiver applies. Core medical services cover 13 types of care such as outpatient care, AIDS drug programs and pharmacy help, dental care, early intervention, help with insurance costs, home health, nutrition, hospice, home and community-based services, mental health, outpatient substance abuse care, and medical case management. Support services are approved services that help people reach their health goals, like transportation, outreach, language help, referrals, and caregiver respite. Early intervention services include testing with follow-up referral and can be offered at places like health centers, ERs, shelters, jails, clinics, and similar sites; providers must show other funds are inadequate and that grant money will add to—not replace—other funds. States must also spend at least the same share of funds on women, infants, children, and youth as their share of people with HIV in the area, unless those groups already get services through Medicaid, CHIP, or other programs. Grant money cannot buy land, build or permanently improve facilities (except minor remodeling), or be given as cash to clients.
