Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXIV — HIV HEALTH CARE SERVICES PROGRAM › Part A — Emergency Relief for Areas With Substantial Need for Services › subpart iii — general provisions › § 300ff–20
The law provides money for carrying out this part. It authorizes these amounts: $604,000,000 for fiscal year 2007; $626,300,000 for 2008; $649,500,000 for 2009; $681,975,000 for 2010; $716,074,000 for 2011; $751,877,000 for 2012; and $789,471,000 for 2013. The Secretary can obligate money until the end of the second fiscal year after the year it was appropriated. For 2007, the Secretary must set aside $458,310,000 for grants under subpart I and $145,690,000 for grants under section 300ff–19. For 2008 and later years, the Secretary must reserve amounts for those same two kinds of grants. If a metropolitan area changes status, some reserved amounts move around. If an area stops being an eligible area, the reserved amount for subpart I is cut by the amount that area got the year before. If the area becomes a transitional area, that cut is added to the transitional reserve. If it is not transitional, the cut is transferred to grants under section 300ff–28(a)(1), in addition to amounts under section 300ff–31b, and the subpart I reserve is cut another $500,000 and that $500,000 is also transferred to section 300ff–28(a)(1). If an area stops being a transitional area (and does not become eligible), the transitional reserve is cut by the prior year’s supplemental grant plus $500,000 and that total is transferred to section 300ff–28(a)(1). For fiscal years 2010–2013, when that transfer happens, part of the prior year supplemental grant is sent to the State for up to three years (75% in the first year, 50% in the second, 25% in the third) and the rest goes to section 300ff–28(a)(1). If an area moves from transitional to eligible, the prior year’s amount is shifted from the transitional reserve to the subpart I reserve. Reductions come first from money set aside for the supplemental grants program and are applied before using those funds for purposes under section 300ff–13(a)(4). If that supplemental money is not enough, the reductions are scaled down so the total matches what is available. These rules apply each time an area goes through such a sequence of years.
