Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXV — REQUIREMENTS RELATING TO HEALTH INSURANCE COVERAGE › Part D — Additional Coverage Provisions › § 300gg–115
Starting January 1, 2022, group health plans and insurers must keep an accurate public list of the doctors and facilities they work with and must check that list often. They must verify and update the online provider list at least every 90 days, remove providers they cannot confirm, and update the list within 2 business days after getting new provider info. If a member calls asking whether a provider is in-network, the plan must reply in writing within 1 business day and keep that reply for 2 years. Printed directories must say when they were published and tell people to check the online list or call the plan for up-to-date info. Provider directory info means the provider’s name, address, specialty, phone number, and digital contact details. State laws about directories still apply. If a person gets care from an out-of-network provider but relied on the plan’s online list, printed directory, or the plan’s response that the provider was in-network, the plan cannot charge higher cost-sharing than it would for in-network care and must count the visit toward the same deductible and out-of-pocket limits. Plans must also post plain, easy-to-read info on their websites and on explanations of benefits about protections against surprise bills, any applicable state rules, and how to contact state or federal agencies to report problems.
