Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXV — REQUIREMENTS RELATING TO HEALTH INSURANCE COVERAGE › Part A — Individual and Group Market Reforms › Subpart II — Improving Coverage › § 300gg–13
Health plans and insurance companies that sell group or individual coverage must pay for certain preventive care and must not make you pay co-pays or other out-of-pocket costs for those services. The required services include items rated "A" or "B" by the United States Preventive Services Task Force; vaccines recommended for you by the CDC’s Advisory Committee on Immunization Practices; preventive care and screenings for babies, children, and teens in the guidelines supported by the Health Resources and Services Administration; and extra women's preventive services in HRSA-supported guidelines beyond the Task Force list. For legal purposes, the Task Force’s current recommendations about breast cancer screening, mammography, and prevention count as the official ones except for recommendations issued in or around November 2009. Plans may also cover more services or keep covering services the Task Force does not recommend. The federal health official in charge must set a waiting time between when a recommendation or guideline is published and when plans must follow it, and that wait cannot be less than 1 year. The official may also make rules that let plans use value-based insurance designs.
