Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXVI — NATIONAL ALL-HAZARDS PREPAREDNESS FOR PUBLIC HEALTH EMERGENCIES › Part C — Strengthening Public Health Surveillance Systems › § 300hh–33
The Secretary of Health and Human Services, through the CDC, must expand, modernize, and keep public health data systems working. The CDC must also give grants to State, local, Tribal, and territorial health departments and public health labs to assess and fix gaps, improve how data are collected, stored, shared, and analyzed, make data exchange more secure and more interoperable with health IT, train staff, support near real-time disease detection, expand electronic case reporting, and share information about using public health data. Not later than 2 years after December 29, 2022, the Secretary, with the Office of the National Coordinator for Health IT, must pick data and technology standards for these systems and favor standards made by consensus-based groups. The Secretary can use earlier advice collected before December 29, 2022 and must align new standards with previously adopted ones. Privacy and security laws stay in effect. Grant applicants must use standards endorsed by the National Coordinator or the Secretary, unless the Secretary waives that rule for a specific applicant. Applicants must explain what they will do and what gaps remain. The Secretary must send a coordinated strategy and implementation plan not later than 180 days after December 27, 2020, and a report not later than 1 year after December 27, 2020, to the Senate and House committees named in the law about barriers, expected impacts, and actions taken. The Secretary may form public‑private partnerships to help with training and technical support. Up to $100,000,000 is authorized for each of fiscal years 2021 through 2025. Electronic case reporting means automatically creating and sharing reports about health events between electronic health records or health IT systems and public health agencies.
