Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XII — SAFETY OF PUBLIC WATER SYSTEMS › Part E — General Provisions › § 300j–3b
The EPA Administrator must create guidelines no later than nine months after October 18, 1978. The guidelines will set extra standards or treatment steps for biological, viral, radioactive, organic, and inorganic contaminants when treated wastewater is to be used for direct drinking. The rules must control each contaminant enough so that no harmful health effects are reasonably expected, with an adequate safety margin. A grant for a water reclamation, recycling, or reuse project that involves direct human consumption can only be awarded after the guidelines are issued if the applicant shows the project will meet all national primary drinking water rules, follow these new guidelines, and otherwise provide safe drinking water. Grants made before the guidelines can be given, but must include the applicant’s promise to follow the guidelines as fully and quickly as possible. The EPA may make the guidelines apply nationwide, by project type, case by case, or any mix of these. Creating the guidelines does not have to delay giving grants before they exist.
