Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXXI — WORLD TRADE CENTER HEALTH PROGRAM › Part A — Establishment of Program; Advisory Committee › § 300mm
Creates a World Trade Center Health Program inside the Department of Health and Human Services, run by a WTC Program Administrator, beginning July 1, 2011. The program pays for medical monitoring and treatment for eligible emergency responders (including Federal employees) who worked after the September 11, 2001 attacks, and it pays for initial health checks, monitoring, and treatment for New York City residents, building occupants, and area workers who were directly harmed. The program includes monitoring and exams, initial evaluations, followup care and payment for needed health and mental health services (including prescriptions), outreach and education, uniform collection and study of clinical data, and research on 9/11-related health problems. Enrolled responders and certified survivors get these services with no deductibles or copays; screening-eligible survivors get initial evaluations with no cost sharing. The HHS Inspector General must look for fraud, duplicate billing, and unreasonable administrative costs. The Administrator and Clinical Centers of Excellence must run a quality program to follow care protocols, make proper referrals, and quickly tell people their test results. The Administrator must send Congress an annual report within 6 months after each fiscal year ends. The report must list applicants and certifications, how many got monitoring and treatment and for what conditions, projected future enrollments, costs for monitoring and treatment and who else paid, administrative costs and performance, participating centers, new scientific findings, and Advisory Committee recommendations. The Secretary must notify Congress when enrollments reach 80 percent of any limits. The Administrator must consult stakeholders. The Comptroller General must report on program effectiveness within 18 months after December 18, 2015, and again not later than 6 years and 6 months after that date and every 5 years through fiscal year 2042. The Administrator may write rules to run the program. The program ends on October 1, 2090.
