Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXXI — WORLD TRADE CENTER HEALTH PROGRAM › Part B — Program of Monitoring, Initial Health Evaluations, and Treatment › subpart 2 — wtc survivors › § 300mm–31
Creates a process to find and document people who can get a health screening and, if needed, ongoing care for illnesses from the September 11 attacks. People already listed by the WTC Environmental Health Center as of January 2, 2011 are included. Others who are not responders but say they have WTC-related symptoms can be found eligible if they meet exposure rules such as being in the dust or dust cloud on September 11, 2001; or working, living, or attending school/daycare in the New York City disaster area for at least 4 days from September 11, 2001 to January 10, 2002 or at least 30 days from September 11, 2001 to July 31, 2002; or being a cleanup/maintenance worker with heavy dust exposure in the first 4 months; or qualifying for certain Lower Manhattan grants and living or working in the area through May 31, 2003. The WTC Program Administrator can change exposure rules after consulting experts, but not after certifications or responder enrollments reach 80% of their caps. People on the Department of Homeland Security terrorist watch list cannot be eligible. Applications are free, decisions must be made within 60 days, applicants can appeal, and written proof of eligibility must be given (already-identified people were to receive it by July 1, 2011). If a screening-eligible person gets an initial health exam and the exam shows they need followup care, the Administrator can certify them for monitoring and treatment. No more than 75,000 people who were not already identified by January 2, 2011 may be certified at any time. The Administrator will limit certifications based on available funds and will give priority by order of application. The initial health exam is provided at a Clinical Center of Excellence using approved protocols, and the program only covers one such exam; people may get extra exams if they pay for them themselves.
