Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XIV — HEALTH RESOURCES DEVELOPMENT › Part E — Program To Assist and Encourage Voluntary Discontinuance of Unneeded Hospital Services and Conversion of Unneeded Hospital Services to Other Health Services Needed by Community › § 300t–12
Gives money to hospitals that stop offering all or part of their inpatient services or that convert part of a hospital to other health care. The HHS Secretary sets the rules and decides how much money each hospital gets. The grant can be used to pay off debt on the closed part of the hospital, to plan and build new health services (including buying equipment), to pay and help staff who lose jobs (like termination pay, retraining, job placement), and for other needed costs the Secretary approves. Hospitals must apply and include what services or parts will close or change, how the change will affect health care in the area, how their costs will change, proof that construction workers will be paid local prevailing wages, and any other information HHS asks for. Local health planning agencies review each application and tell the State Agency whether the service is needed and whether conversion services are needed. The State Agency then recommends approval or denial to HHS, paying special attention to needs of poor urban and rural populations. HHS won’t approve an application if the State Agency opposes it or if closing the services won’t lower area inpatient costs. The Secretary of Labor must certify that fair arrangements protect workers’ jobs, benefits, bargaining rights, retraining, and severance. Labor must review applications within 90 days (or 120 days in some cases); if Labor does not act in time, HHS will review the worker protections. Records and audits rules apply. For this program, a “hospital” is one that meets Medicare participation rules, charges for services, and had average patient stays of 30 days or less; federal and psychiatric hospitals are excluded.
