Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XVII — BLOCK GRANTS › Part B — Block Grants Regarding Mental Health and Substance Use › subpart i — block grants for community mental health services › § 300x–3
To get the federal grant, a State must create and keep a State mental health planning council. The council must read the State’s mental health plans and suggest changes. It must speak up for adults with serious mental illness, children with severe emotional problems, and others with mental health needs. At least once a year the council must check how mental health services are shared out and whether they are enough. Council members must live in the State and include people from main State agencies (mental health, education, vocational rehab, criminal justice, housing, social services, and those who work on the Medicaid plan), public and private groups involved with mental health, adults who have gotten mental health services, and families of those adults or of children with emotional disturbance. The council must have enough parents of affected children to give those children a real voice, and at least 50% of members cannot be State employees or mental health service providers. Council means the State mental health planning council.
