§300x–7 Determination of Amount of Allotment

Summary

The Secretary must work out each State’s yearly allotment from the money Congress set aside by using a detailed formula. First, the pool to split (called “A”) is the total appropriation for allotments minus 1.5 percent. Each State’s share is built from a value “X” and all States’ Xs add up to “U.” For each State, X is P times a cost-adjustment factor times the larger of 0.4 or another number calculated from A, the State’s R% and P% using the statute’s formula. P is a weighted count of the State’s people by age: 0.107 times ages 18–24, 0.166 times ages 25–44, 0.099 times ages 45–64, and 0.082 times ages 65+. The Secretary must use the latest Census data and estimates. R% is the State’s three-year average total taxable resources per the Treasury (adjusted by the factor) divided by the sum for all States; the District of Columbia uses three-year average personal income instead. P% is the State’s P divided by the sum of all States’ P. The cost factor adjusts for differences in service costs, follows the March 30, 1990 methodology, cannot exceed 1.1 or be under 0.9, was first set by October 1, 1992, and is recalculated every third fiscal year with occasional refinements published by the Secretary. Starting in fiscal year 2000, a State’s allotment cannot be less than what it got in fiscal year 1998. For U.S. territories, the Secretary sets aside 1.5 percent of the appropriation each year for them. Each territory’s allotment is that reserved amount times the territory’s share of the territories’ civilian population, but it must be at least $50,000 (and for 1993–1994 at least 20.6 percent of what the territory got in 1992). If recent territory population data are not available, the Secretary will estimate population changes by using the average change seen in territories that do have recent data. For the State formula, “State” does not include the territories.
