Title 42 › CHAPTER 43 — DEPARTMENT OF HEALTH AND HUMAN SERVICES › SUBCHAPTER I — GENERAL PROVISIONS › § 3515e
Moves to the Administration for Community Living (ACL) all of the duties and programs the Commissioner of the Rehabilitation Services Administration (RSA) used to run under Title VII of the Rehabilitation Act and the Assistive Technology Act. It also moves the National Institute on Disability and Rehabilitation Research (NIDRR) functions into a new NIDILRR inside ACL. The ACL Administrator may delegate tasks, reorganize offices, and make rules as needed to run these programs. Staff, contracts, property, records, and unspent money tied to the moved programs go to ACL and any unspent funds must still be used for their original purpose. The Office of Management and Budget (OMB) must make sure these transfers do not increase the total number of federal full-time employees and must certify compliance within 1 year after the law takes effect to the House Committee on Education and the Workforce and the Senate Committee on Health, Education, Labor, and Pensions. Existing orders, permits, grants, contracts, regulations, pending applications, and court cases tied to these functions continue without interruption. OMB may make any extra technical transfers or wrap-up decisions needed to finish the change. References in other laws to the RSA or its Commissioner now mean ACL or its Administrator. During the transition, ACL may use RSA staff and funds for a reasonable time to carry out the move. Defined terms: “Administration for Community Living” = ACL in HHS; “Federal agency” = agency as defined in title 5; “function” = any duty or program; “Rehabilitation Services Administration” = RSA in the Department of Education; “NIDILRR” and “NIDRR” = the new and old research institutes.
