Title 42 › CHAPTER 77 — ENERGY CONSERVATION › SUBCHAPTER III — IMPROVING ENERGY EFFICIENCY › Part E — Energy Conservation Program for Schools and Hospitals › § 6371c
The federal official in charge of the program (the Secretary) must ask each State energy agency to send a plan within 90 days after the federal guidelines take effect, or later if the Secretary allows for good cause. The plan must show results of the preliminary energy audits and estimated energy savings; recommend the kinds of energy projects for schools and hospitals and give yearly cost estimates; say how qualified people will be found to do the work; set fair rules for giving out funds based on need and energy savings and make sure all eligible public or nonprofit institutions are treated fairly; explain how the State will encourage solar heating, cooling, and water heating where appropriate; include rules to make sure all money is spent under the approved plan and the law; require energy‑saving maintenance and operating procedures for the facilities that get projects; and have policies to make sure federal money adds to, and does not replace, State or local funds. The Secretary must approve or disapprove each plan within 60 days after getting it. If a plan was sent in the 90‑day window and the Secretary does not disapprove it within 60 days, the plan is treated as approved. A State can submit a new or changed plan later if the Secretary agrees. If no plan is approved within 2 years and 90 days after November 9, 1978, or within 90 days after the preliminary audits are finished (whichever is later), the Secretary can make and run a plan for that State. A State may also send a proposed plan at any time; the Secretary must decide on it within 60 days and will approve it and replace any Secretary‑made plan if it meets the requirements and does not conflict with the Secretary’s plan.
