Title 42 › CHAPTER 77 — ENERGY CONSERVATION › SUBCHAPTER III — IMPROVING ENERGY EFFICIENCY › Part E — Energy Conservation Program for Schools and Hospitals › § 6371g
The Secretary must use 90% of the yearly money from section 6371f(b) for energy conservation project grants. Of that 90%, 80% is split among the States using a formula the Secretary creates that looks at population, climate, and other factors. Ten percent is shared among the States based on fuel or energy availability, cost, and how much schools and hospitals use. The remaining 10% is set aside to pay grants that go beyond the 50% limit in section 6371e(b)(1), as allowed under section 6371e(b)(2). If a State already got more than 50% of an energy-audit cost in a year, that State’s total allocation is cut by the extra amount and that cut is reallocated to other States, but the State that got the extra cannot get any of the reallocated money. No State can receive more than 10% of the total allocated to all States in a year. Except for the District of Columbia and the listed territories, any State with an approved plan must get at least 0.5% of the yearly total for all States. The Secretary must write rules for the formulas, for audit fund shares (rules due within 60 days after November 9, 1978), and for limits on State administrative spending. Funds allocated but not obligated in a fiscal year can be reallocated the next year.
