Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER IX — REGULATION OF UNDERGROUND STORAGE TANKS › § 6991a
Tank owners must tell a state or local agency about any underground storage tank within 18 months after November 8, 1984. The notice must say how old the tank is, how big it is, what type it is, where it is, and how it is used. Tanks taken out of use after January 1, 1974 must also be reported within that 18‑month period unless the owner knows the tank was removed. For those out‑of‑use tanks, owners must give the date taken out of service, the tank’s age then, its size/type/location, and what and how much was left inside. If a tank starts being used after the first reporting period, the owner must report it within 30 days. These reporting rules don’t apply to tanks already reported under an earlier federal notice requirement. Governors must pick which state or local agencies get the reports within 180 days after November 8, 1984. The EPA must create a standard report form within 12 months after that date and consider small businesses. States must make two lists of their tanks (one for petroleum, one for other regulated substances) from those reports and send the totals to the EPA by 270 days after October 17, 1986. States that get federal money must keep a public, yearly record of tanks and include release numbers/causes, compliance records, and equipment‑failure data.
