Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER IX — REGULATION OF UNDERGROUND STORAGE TANKS › § 6991c
States may send the EPA a plan to run their own underground storage tank programs starting 30 months after November 8, 1984. To be approved, a State plan must require ways to find leaks, keep records, report and fix releases, close tanks safely, set rules for new tanks, show proof of money or coverage to pay for cleanup and damage, notify the right agency about tanks, and set required training. The parts about leak detection, records, reporting, fixing releases, closures, financial responsibility, and new-tank rules must be at least as strict as the federal rules. States get a short extra time to match new federal rules: one year if only agency rules are needed, or two years (plus one more year if laws force rule-writing) if the State must change its laws. States can use state cleanup funds or other programs to meet the money-proof rules. Money-proof can be insurance, bonds, letters of credit, self-insurance, or other methods the EPA accepts. If an owner or operator is bankrupt, claims can be made against the guarantor who provided the money-proof, but that guarantor’s total liability is limited to the amount they promised. “Guarantor” means someone, other than the owner or operator, who provides that money-proof. The EPA must decide within 180 days after getting a proposed State plan whether it meets the rules, after public notice and comment. If the State fails to run the program properly and does not fix problems within 120 days after a notice, the EPA can withdraw approval and take back the federal program. The EPA must give States at least 80% of certain Trust Fund money each year for State cleanup work, related admin costs, or enforcement. The EPA sets how those funds are split, may refuse funds to States that diverted tank funds (except transfers done before August 8, 2005), and will consult States before changing the allocation method.
