Title 42 › CHAPTER 84 — DEPARTMENT OF ENERGY › SUBCHAPTER V — ADMINISTRATIVE PROCEDURES AND JUDICIAL REVIEW › § 7194
The Secretary must allow changes to rules named in section 7191(a) that were issued under the Federal Energy Administration Act, the Emergency Petroleum Allocation Act of 1973, the Energy Supply and Environmental Coordination Act of 1974, or the Energy Policy and Conservation Act. Those changes must prevent special hardship, unfairness, or an unequal sharing of burdens. The Secretary must create a process anyone can use to ask for an explanation, a change, a removal, an exception, or an exemption, and each decision must say what standards were used and how they apply to the request. If someone is denied, they can ask the Commission to review that denial and can go to court once the denial is final. The Commission must set rules for review, including a hearing if asked. The Commission’s decision is final within the agency and won’t be re-decided by the Secretary, and the Secretary handles any related court cases.
